Huawei Cloud Construction Cloud Service (hereinafter referred to as "Construction Cloud", "we", "us", "our", "Huawei Cloud", or "this Service") is operated by Sparkoo Technologies Singapore Pte. Ltd. to provide you with services or products. We understand and fully respect the importance of your privacy. We are committed to taking appropriate security measures to protect your personal information in accordance with relevant laws and established industry security standards. Before you use our products and services and submit your personal information to us, please carefully read this Huawei Cloud Construction Cloud Service Privacy Statement (hereinafter referred to as "this Statement") and related supplementary documents, especially the terms in bold.
This Statement describes how we collect, use, and disclose your personal information, as well as legal bases and security measures implemented by us to process your personal information. You can exercise your legal rights in the ways and means described in this Statement. However, this Statement may not cover all scenarios. We will inform you of specific services or functions that will collect your personal data through further statements or notifications. You reserve the right to agree to or reject such forms of data collection.
If you are an enterprise and/or organization, this Statement is legally binding upon you after you enable this Service, read, understand, and accept this Statement, and complete registration. If you are an end user, this Statement is legally binding upon you after you enable this Service for the first time, read, understand, and accept this Statement. If you do not accept some or all of the terms herein, the services and functions provided for you may be limited.
This Statement applies to the Construction Cloud products, functions, and services presented through web pages or other means, including the end-to-end management functions such as project initiation, estimation, budgeting, accounting, and final accounting management, design management, procurement management, engineering management, environment, health, and safety (EHS) management, and acceptance management. The functions and services may vary with the subscription and purchase requirements of tenants.
Definitions:
Enterprise/Organization (also called "enterprise/organization user" or "your enterprise") refers to a legal person or entity that authorizes a natural person to register an enterprise/organization account and use it to enable this Service. The enterprise/organization has all management permissions of this account. An enterprise/organization can authorize administrators to create a dedicated workspace. Administrators can and authorize end users to join the workspace to create a collaborative office.
Enterprise/Organization account refers to the object records the enterprise/organization information in this Service.
End user (also called "authorized user", "individual user", or "you") refers to the individual who is authorized or invited by an enterprise/organization to join in the workspace in this Service. If an end user obtains the workspace management permission of an enterprise/organization, the end user is also called the enterprise/organization administrator.
Enterprise/Organization administrator (also called "enterprise administrator") refers to an end user authorized by an enterprise/organization to configure and manage their workspace through the management console in this Service. If an enterprise/organization authorizes a natural person to register and enable an enterprise/organization account in this Service, the natural person automatically becomes the enterprise/organization administrator. An enterprise/organization can have multiple administrators with different permissions.
System administrator refers to a user provided by Huawei Cloud as authorized by an enterprise/organization to configure and manage the construction cloud services through the management console of this Service. By creating an enterprise tenant, the enterprise authorizes Huawei Cloud to create and manage the system administrator account for stable and reliable running and operations of Construction Cloud, routine function upgrades, and platform O&M. This account is neither granted any service data permissions of any enterprise/organization tenant, nor involved in the service management of any enterprise/organization tenant.
Personal information refers to various types of information recorded electronically or otherwise relating to an identified or identifiable natural person, excluding information that has been anonymized.
Sensitive personal information refers to personal information which, once leaked or illegally used, may easily cause harm to the dignity of natural persons or damage to personal or property safety, including information relating to biometric recognition, religious beliefs, specific identities, healthcare, financial accounts, individual location tracking, etc., as well as personal information of minors under the age of 14.
Anonymization refers to the process after which personal information can no longer be used to identify a specific natural person and cannot be restored.
De-identification refers to the process after which personal information can no longer be used to identify a specific natural person without additional information.

1. How We Collect and Use Your Personal Information

1.1 Personal Information We Collect
To provide you with excellent products and services, we only collect personal information required for normal service operations. The personal information we collect depends on the services and features you use. You can agree to or reject our request to collect your personal information. Some services and functions will be available only if you provide personal information.
The following describes the scenarios in which we collect, process, and use your personal information.
1.1.1 Enterprise/Organization Account Registration
To provide you with the enterprise/organization account registration function and enter into and fulfill the service agreement signed between you and us, when you register a Huawei Cloud enterprise account, Huawei Cloud will collect, in accordance with the officially released Privacy Statement, the enterprise contact information you provide, including the name, mobile number, email address, enterprise name, company address (region), and industry.
1.2 Personal Information Entrusted by Enterprises or Organizations
End users herein refer to the users authorized by an enterprise/organization to access or use this Service. If you are an enterprise/organization, you promise that, as the personal information processor, you have obtained end users' consent or have control over end users' personal information according to applicable laws. That is, you promise that you have obtained authorization and have the right to authorize us to process end users' personal information mentioned in this Statement. You shall be responsible for the security of personal information and data privacy in accordance with applicable laws governing end users' personal information under your control.
If you are an end user, please confirm that your enterprise/organization obtained your explicit authorization in written or electronic form before collecting and submitting your personal information or legally owns your personal information and that you have been fully informed of the purpose, scope, method, and period of collecting and using your personal information. If you cannot make this confirmation, please stop accessing or using this Service until you confirm with the enterprise/organization. You can also contact us through the information provided in this Statement. We will cooperate with you and handle such issues to the best of our ability.
If you are an end user, we receive and process the following personal information entrusted by an enterprise/organization.
1.2.1 Account Registration
To provide your enterprise/organization with the account registration function to initialize your account identity to the tenant space managed by your enterprise/organization, we will process the account information and authentication information you entered, including the mobile number, email address, user ID, and account password. For security management purposes, your enterprise/organization may connect its authentication system and use the single sign-on (SSO) method. In this case, we will not collect your authentication information but only obtain your account ID and authentication result to link your Construction Cloud account.
1.2.2 Account Login
To provide your enterprise/organization with the account verification function to check whether your account belongs to the enterprise/organization during login, we will process the account information and authentication information you entered, including the mobile number, email address, user ID, and account password. For security management purposes, your enterprise/organization may connect its authentication system and use the SSO method. In this case, we will not collect your authentication information but only obtain your account ID and authentication result to link your Construction Cloud account.
2. How We Use Cookies
To ensure normal operations of this Service, we may store small data files known as cookies on computers or mobile devices. A cookie is a text file stored by a web server on a computer or mobile device. The content of a cookie can be retrieved or read only by the server that creates the cookie. Each cookie is unique to your web browser or mobile application. Cookies usually contain identifiers, site names, numbers, and characters. With cookies, a website can store data about your preferences and other information.
Like most websites or Internet service providers, we use cookies to improve user experience. Specifically, the purposes are as follows:
a. Cookies allow websites to save settings and language preferences on computers or mobile devices. This means that you do not need to reset the preferences on a website for every visit.
b. Authentication. When you visit the Huawei Cloud Construction Cloud Service website, a unique ID is generated to identify you. If the website does not use cookies with the authentication function, it will consider every visitor a new visitor each time they visit the website. For example, if such cookies are not used, and you log in to the website and switch to another page, the website will consider you a new visitor.
c. Security. We use cookies to ensure website security.
You can manage or delete cookies based on your preferences. For details, visit AboutCookies.org. You can clear all cookies stored on your computer, and most web browsers can be configured to block cookies. However, by doing so, you have to change the user settings every time you visit our website.
3. How We Share, Entrust, Transfer, and Disclose Your Personal Information
3.1 Sharing
We will not share your personal information with third parties, except in the following circumstances:
a. Sharing after your explicit consent. After notifying you of the third party's name, contact information, the processing purpose, processing method, and personal information type and obtaining your explicit consent, we will share information with the third party within the scope of your authorization.
b. Sharing your personal information to fulfill related agreements (including agreements and platform rules) that you signed with us and other legal documents.
c. Sharing under statutory circumstances. We may share your personal data in accordance with applicable laws or regulations, legal procedures, litigation/arbitration, government's compulsory orders, and regulatory requirements. For example, we may share your personal data with relevant government agencies or authorized third parties for real-name authentication in compliance with applicable laws and regulations.
d. Sharing your personal information within the extent required or permitted by law to protect the interests, property, or safety of yourself or the public.
e. Sharing your personal information to protect national security, public security, and the legitimate rights and interests of yourself or others.
f. Sharing your personal information that is disclosed to the public by yourself or accessible from other legal public channels.
3.2 Transfer
We will not transfer your personal information to any company, organization, or individual, except in the following circumstances:
a. With your explicit consent, we may transfer your personal data to other parties.
b. Your personal data may be disclosed to transaction parties in case of restructuring, merger, spin-off, dissolution, or bankruptcy.
3.3 Public Disclosure
We will not disclose your personal information except in the following circumstances:
We may disclose your personal information to protect national security, public security, and the significant legitimate rights and interests of you and others based on applicable laws and regulations. For example, we may disclose your personal data when we believe disclosure is necessary or appropriate to prevent or defend against cyber threats, frauds, physical harm, or financial loss, or when it is in connection with an investigation of suspected or actual illegal activities.
We only disclose your personal information to the extent permitted by applicable laws and regulations and pursuant to this Statement.
4. How We Store Your Personal Information
4.1 Data Storage and Retention
We will retain your personal data for no longer than is necessary for the purposes stated in this Statement, unless otherwise required by law or by you. The data storage period may vary with the processing purposes and services.
We will retain your account information as necessary to provide you with services, fulfill our obligations, or exercise our rights under agreements related to the services. You can choose to close your account. After you close your account, we will stop providing you with services and delete your personal data within a reasonable period of time, except for certain personal data that we are required to continue to process by law.
4.2 Data Storage Location
In accordance with applicable laws and regulations, the personal information collected by this Service will be stored in a data center ("server") within Singapore.
5. How We Protect Your Personal Information
We take appropriate physical, organizational, and technical measures to protect your personal information from unauthorized access, disclosure, use, modification, damage, and loss. For example, we use cryptographic technologies for data confidentiality, protection mechanisms to prevent attacks, and access control mechanisms to permit only authorized access to your personal information. We also provide training on security and privacy protection for employees to raise their awareness of personal information protection.
Although we are committed to protecting your personal information, you are also responsible for safeguarding it, including but not limited to accounts, passwords and authentication information. If you find your account or password is used by others without your permission or abnormal use occurs, contact us or notify your enterprise/organization administrator of it promptly. You have the right to request your enterprise/organization to suspend any unauthorized use of your account or password.
No security measure is perfect and no product, service, website, data transfer, computing system, or network connection is absolutely secure.
6. How You Access or Control Your Personal Information
6.1 Your Rights to Personal Information
You may have the following rights regarding your personal information under applicable laws:
a. Access the personal information that we hold about you and obtain copies thereof.
b. Request us to update or correct your personal information.
c. Request us to delete your personal information.
d. Object to our processing of your personal information.
e. Restrict our right to process your personal information.
f. Complain to supervisory authorities and relevant government organizations.
Please note that these rights are not absolute and may be restricted under applicable laws.
6.1.1 Access, Update, and Correct Your Information
a. Enterprise/Organization information
If you are an authorized administrator of your enterprise/organization, you have the right to query, correct, and supplement the information about the enterprise/organization, including the enterprise name, position, contact address, and industry. To do so, log in to the Huawei Cloud official website, click your account in the upper right corner, and click the avatar to access the account center.
b. End user information
If you are an end user of an enterprise/organization and need to modify your phone number or email address, ask the administrator of your enterprise/organization to modify the information on the management console.
6.1.2 Delete Your Information
If you are an end user of an enterprise/organization and need to delete some or all of your personal information, ask the administrator of your enterprise/organization to delete the information on the web management console.
6.1.3 Deregister Your Account
a. Enterprise/Organization
If you are an authorized administrator of your enterprise/organization, you can deregister the enterprise/organization account on the Huawei Cloud official website.
b. End user
If you are an end user of an enterprise/organization and need to deregister your account, ask the administrator of your enterprise/organization to deregister your account on the Construction Cloud management console.
6.2 Data Accuracy and Integrity
You shall ensure that all personal information submitted is accurate. We will try our best to maintain the accuracy and completeness of personal information and update the data in time.
7. How We Process Minors' Personal Information
Our services are intended for adults. You hereby represent and warrant that you are an adult when you start using this Service. Minors under the age of 14 are not allowed to create accounts without the consent of their parents or guardians.
If the personal information of minors under the age of 14 is collected with the consent of their parents or guardians, we will use or disclose the personal information only when permitted by law, with the explicit consent of their parents or guardians, or necessary for the protection of minors under the age of 14.
If Huawei Cloud finds that it has collected personal data of minors under the age of 14 without obtaining provable consent of their parents or guardians in advance, we will try to delete the collected personal data as soon as possible.
8. How Your Personal Information Is Transferred Internationally
To provide you with services, we collect your personal information and store it in a data center in Singapore according to 4.2 "Data Storage Location".
9. How This Statement Is Updated
We may update this Statement from time to time according to changes of our services. If we update this Statement, we will notify you at the earliest. You are advised to learn about the latest changes of this Statement after a version upgrade. If you do not agree to the clauses in the latest statement, please stop using this Service. By continuing to use this Service, you acknowledge that you are aware of and agree to the latest version of this Statement.
10. How to Contact Us
We have a dedicated department for personal information protection. You can contact us by visiting the Personal Data Management Request page to exercise your rights. We will reply as soon as possible. We will try our best to respond to and process your requests. If we fail to reply in time, we will inform you of the reasons for the delay. We will comply with laws and regulations and try our best to reply within 15 working days of verifying your identity and confirming your issues.
If you are not satisfied with our reply, and you think that your legitimate rights and/or interests have been harmed when we handle your personal information, you may file a complaint or lawsuit with data protection authorities or other regulatory authorities with jurisdiction. We will respond to your legitimate rights and interests accordingly.
